Selfdestruct is a cloud-based service that allows you to exchange encrypted notes with your partners, coworkers, and acquaintances via shareable links that self-destruct after being opened. This Terms of Service (the "Terms") governs your access to and use of Selfdestruct's services (the "Services").
You agree to these Terms if you use our Services. If you are prohibited from doing so by relevant law, please do not use the Services.
Encryption: By using the Service, you understand that the content uploaded and/or shared over the Service ("Customer Files") are encrypted using client-side encryption before leaving the User's device ("Encrypted Content"). Encrypted Content cannot be decrypted or inverted by Selfdestruct or any unauthorized third party, to the best of Selfdestruct's knowledge and current state of the art.
Encryption Key: Selfdestruct does not have access to encryption keys and has no way of recovering encryption keys associated with your Encrypted Content. Selfdestruct is not responsible if Encrypted Content is unable to be decrypted due to a lost encryption key. Users are strongly advised to make backups of any content on their own systems.
Limited Permission: Except for the limited rights that are reasonably necessary for Selfdestruct to deliver the Services in compliance with this Terms, this Terms does not grant Selfdestruct any ownership over the contents of Customer Files or over Customer's intellectual property.
Content: You realize that Selfdestruct protects Customer Files with powerful cryptographic techniques, and that as a Customer, you are totally and alone responsible for the content of Customer Files. You warrant that you have all necessary licenses for each Customer File – including copyright and other intellectual property rights – to distribute, transfer, store, and/or make the material available online through the Services by utilizing the Services.
Data processing: Selfdestruct gathers certain non-encrypted information ("Service Data"), which don't contain Personal Data, in order to operate and provide the Services. Customer acknowledges that Encrypted Content is not considered Personal Data by Selfdestruct due to client-side encryption, as Selfdestruct cannot use encrypted information to identify any individual.
Sub-processors: Customer accepts that in providing the Services, Selfdestruct will use authorized service providers to process Encrypted Content and Service Data ("Sub-processors").
Data transfers: Customers agree that Selfdestruct and its Sub-processors may transport Encrypted Content and Service Data between their servers and Users' devices, allowing Users access to Customer Files in countries other than Customer's.
Data Loss: We will not be liable for any data loss or damage under any circumstances.
Eligibility to use: You represent and warrant that you are of legal age (18 years of age or older in your resident jurisdiction) and competent to enter into this Agreement.
Compliance: As between the parties, Customer is responsible for following the terms of this agreement. Customer is solely responsible for adhering to all applicable laws and regulations when using the Services. Customer is solely responsible for assessing whether the Services are accurate or adequate for its needs.
Internet accessibility: You acknowledge that certain Services functions require an Internet connection. You are responsible for obtaining and maintaining network connections that connect your network to the Services, including but not limited to "browser" software that supports Selfdestruct protocols. You are responsible for obtaining and maintaining all necessary connectivity, computer software, hardware, and other equipment to access and use the Services.
Use of the Services: The Services are Selfdestruct's or Selfdestruct's licensors' property. During the length of this Terms, Selfdestruct offers you limited, non-exclusive, revocable right to use the Service. You agree not to use the Services in any way that is prohibited by these Terms.
Selfdestruct has the right to amend the terms of this Terms at any time, including in response to changes in the Services or relevant laws and regulations, and the most recent version will always be available on Selfdestruct's website.
